Terms and Conditions

Participation in the Top Investable Artists of 2026 Art Book & Investable Artists Directory 2026

These Terms and Conditions (“Terms”) govern your participation in the Top Investable Artists of 2026 Art Book (the “Book”) and the Investable Artists Directory 2026 (the “Directory”), both produced by Art Market Experts (“Company”). By submitting payment and confirming your participation, you (“Artist”) agree to be bound by the following Terms.

 

1. Eligibility & Invitation

1.1 Participation is strictly by invitation. Invitations are extended to artists who, in the opinion of Art Market Experts, meet professional standards of quality and investment potential.
1.2 Invitations are non-transferable and may not be sold, exchanged, or reassigned to another individual.

 

2. Scope of Services

2.1 Upon confirmation of participation, the Artist will receive:

  • A double-page printed and digital feature in the Top Investable Artists of 2026 Art Book.

  • *Placement in the Investable Artists Directory 2026 (digital edition).

2.2 Each double-page feature will include:

  • Two (2) high-resolution images of the Artist’s artwork (supplied by Artist).

  • A short biography of up to 250 words.

  • Artist’s direct contact information (website, email, or other approved details).

2.3 The Book will be published in print and digital format, available globally via Amazon, Barnes & Noble, WHSmith, Foyles, Blackwell’s, and other selected distributors.

2.4 The Directory will be published digitally and distributed privately to vetted collectors, curators, and galleries.

 

3. Fees & Payments

3.1 Participation requires a one-time fee of €350 (the “Fee”).
3.2 The Fee is payable in full at the time of application.
3.3 Payments are accepted via PayPal, credit/debit card, or bank transfer.
3.4 All payments are final and strictly non-refundable.

 

4. Submission Requirements

4.1 The Artist is responsible for submitting all required materials within the stated deadlines, including:

  • Two (2) high-resolution artworks at a minimum of 300 DPI.

  • A biography (up to 250 words).

  • Contact details for publication.

4.2 Materials must be submitted through the secure upload link provided upon confirmation.
4.3 Art Market Experts reserves the right to reject or request replacement of any materials deemed unsuitable (poor quality images, offensive content, or works that do not meet publication standards).

 

5. Deadlines & Availability

5.1 Spots are strictly limited to the final 5 invitations. Once full, the opportunity closes permanently.
5.2 If the Artist fails to submit required materials within the deadline, their feature may be forfeited without refund.

 

6. Design & Editorial Control

6.1 The design, layout, and final presentation of the Artist’s feature are at the sole discretion of Art Market Experts.
6.2 Minor text corrections may be requested free of charge if submitted prior to final design approval.
6.3 Substantial revisions (e.g., new artworks, rewritten biography, or replacement of text/images after design is complete) will incur additional fees, as determined by Art Market Experts.

 

7. Distribution & Copies

7.1 The Book will be made available in print and digital editions.
7.2 Printed copies are not included in the participation fee. Artists may purchase copies directly through Amazon, Barnes & Noble, or other listed retailers once available.
7.3 Art Market Experts makes no guarantee regarding the number of retail outlets carrying the publication, as availability may vary by region.

 

8. Marketing & Promotion

8.1 Art Market Experts will market and promote the Book and Directory to its global network of collectors, curators, and galleries.
8.2 While reasonable efforts are made to maximize exposure, no guarantee of sales, representation, or financial outcomes can be made.
8.3 Participation constitutes consent for Art Market Experts to use submitted images and texts for marketing, promotion, and distribution purposes related to the Book and Directory.

 

9. Artist’s Responsibilities & Warranties

9.1 The Artist affirms that all submitted works are original and that they hold full rights to publish the materials.
9.2 The Artist grants Art Market Experts a non-exclusive license to reproduce and distribute submitted materials in print and digital formats for the purposes of publication, marketing, and promotion.
9.3 The Artist agrees to indemnify and hold harmless Art Market Experts from any claims related to copyright infringement, misrepresentation, or third-party disputes arising from their submitted materials.

 

10. Limitation of Liability

10.1 Art Market Experts shall not be liable for:

  • Lost sales, missed opportunities, or unrealized exposure.

  • Technical errors, printing delays, or distributor-related issues beyond its control.

  • Any indirect, incidental, or consequential damages related to participation.

10.2 The maximum liability of Art Market Experts shall not exceed the amount paid by the Artist for participation (€350).

 

11. Termination & Forfeiture

11.1 If the Artist fails to provide materials on time, submits unsuitable content, or violates these Terms, Art Market Experts reserves the right to remove or withhold their feature without refund.

 

12. Governing Law

12.1 These Terms shall be governed by and construed in accordance with the laws of the European Union.
12.2 Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of competent courts within the EU.

 

13. Final Agreement

13.1 By submitting payment and confirming participation, the Artist acknowledges and agrees to these Terms in full.
13.2 These Terms represent the entire agreement between the parties and supersede all prior communications.
